Roundup® Weed Killer is a lawncare product found in many homes. Recently, studies conducted at the International Agency for Research on Cancer—a division of the World Health Organization—discovered a possible link between glyphosate, the main herbicidal ingredient in Roundup, and certain types of cancer, such as non-Hodgkin lymphoma.
If you or someone you love was diagnosed with non-Hodgkin lymphoma or any other type of cancer after being exposed to Roundup or a similar herbicide, get in touch with us now, and let our Appleton defective product lawyers start protecting your rights today.
Is Your Cancer Diagnosis Roundup-Related?
While there is no definitive link between herbicides that contain glyphosate, including Roundup, and certain types of cancer, the products are now under intense scrutiny and further investigation after a surge of lawsuits filed by people worldwide who believe they developed cancer, including non-Hodgkin lymphoma, after being exposed to herbicides that contain glyphosate.
Roundup is common in homes and farms nationwide, which has resulted in countless people being exposed to it and its ingredients since its introduction in the 1970s. Additionally, you don’t have to have used Roundup in your work or on your property to have been exposed to glyphosate.
Roundup and glyphosate exposure can occur in several different ways, such as:
- Breathing airborne particles after the product was sprayed
- Absorbing chemicals through the skin after touching treated plants and weeds
- Drinking contaminated water that was exposed to the product
- Eating food that was grown in contaminated soil
People in all geographic areas of the U.S., including suburbs, farms, rural areas, and cities, may have been exposed to Roundup, glyphosate, and their health-related risks. If you’ve developed non-Hodgkin lymphoma and believe it may be Roundup-related, call Brian Hodgkiss Injury Lawyers for a free consultation.
If Roundup Caused My Cancer, Can I Get Compensation?
Roundup cancer victims can receive three main types of compensation.
- Economic damages – This type of award is designed to compensate the victim for past and ongoing medical expenses they’ve had to pay due to their illness, as well as any lost wages if their illness left them unable to work while they recovered.
- Non-economic damages – This type of award is designed to compensate the victim for physical pain and emotional distress they suffered or may continue to suffer due to their illness.
- Punitive damages – This type of award is unique because it is designed to punish defective product manufacturers for their negligence rather than to compensate the victim, although the victim still receives the award.
Roundup Cancer Settlements in the News
In August 2018, a jury in San Francisco awarded $289 million in damages to a man who was diagnosed with terminal cancer after routinely using Roundup as part of his job. The case, filed on behalf of a former school groundskeeper, was the first Roundup cancer case to go to trial. Jurors in the case cited the need to punish Monsanto for their negligence as a significant factor behind the size of the award.
In March 2019, a California federal jury ruled that Roundup was a “substantial factor” in the victim’s diagnosis of non-Hodgkin lymphoma and ordered Monsanto to pay roughly $80 million in damages, including just over $200,000 in past economic loss, roughly $5 million in future economic loss, and $75 million in punitive damages. Because this case was decided in a federal court, it’s considered a “bellwether trial” and has great impact on future cases.
In May 2019, an Alameda County Superior Court jury awarded a couple $2 billion dollars after ruling that Monsanto was liable for their cancer diagnoses after failing to properly warn consumers of their product’s dangers.
Thousands more Roundup cancer cases are pending in state and federal courts across the United States. The outcomes of these cases may also set a precedent for verdicts to follow.
